A foreigner can open a business in two forms: sole proprietorship (jednoosobowa działalność) and partnership (spółka).
Important: To open a sole proprietorship in Poland, a foreigner must have a residence card, a Pole’s card, permanent residency, citizenship, or a “business harbor” visa for Belarusian citizens. This last point was recently added to the list of exceptions allowing a foreigner to open a sole proprietorship.
EU citizens and their family members also have the right to open a sole proprietorship.
In other cases, opening a sole proprietorship is almost impossible. Rare exceptions are entrepreneurs who already have a developed business with significant turnover in other countries. Such a foreigner must have a very strong business plan with step-by-step actions for business development in Poland.
